Terms and Conditions

 

In these Terms & Conditions the following definitions apply:

“Services or activities” means classes, workshops, sessions, consultations, treatments or therapies provided by Tipi Yoga.                          

“Website” means the Tipi Yoga website (www.tipiyoga.co.uk) and any other websites or social media pages administrated by Tipi Yoga.

“Studio” means Tipi Yoga.

“Studio owner” means the Tipi Yoga owner.

"TY" refers to Tipi Yoga.

“Studio user”, "Tipi Yoga user" and "TY user" means anyone taking part in Tipi Yoga services.

"Teacher" refers to the person(s) leading the provided services or activities (listed above).

“Terms” means these Terms & Conditions.

PRE-CONDITION OF USE 
By using the website and studio facilities you understand and accept the Terms and Conditions as outlined in this document.

AMENDMENT OF TERMS 
Tipi Yoga reserves the right to vary or revoke the terms at any time, which it may consider necessary or suitable for the regulation of the governance of the studio and the conduct of studio users.  Any such changes will be published on the studio website(s) and, until revoked, are binding on studio users.  The scheduling and content of services and activities may be changed on occasion with or without prior notice given to Tipi Yoga users.  Tipi Yoga users will be advised if changes are made to the Terms and Conditions.

CLIENT HEALTH AND RISK

TY users are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition.  TY users must notify the TY owner and/or teacher of any circumstances affecting their health which may be exacerbated through continued use of the services or activities.

TY reserves the right to refuse access to any TY user if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such services and activities.

As with all forms of physical exercise there are risks up to and including death, to maintain the safety of individuals and groups TY users are required to follow the instructions of the teachers, studio supervisors or TY owner at all times. By attending a class the TY user is agreeing to take part having assessed the risks posed to them. 

TY users are required to update teachers with any changes to their medical, physical and mental wellbeing prior to participations.

COVID - 19

If you or anyone is your household has COVID-19 symptoms please do not attend any TY services or activities. If you have a class booked please let the teacher know ASAP, you will not be charged and can receive a refund.

Hall classes will remain ventilated where/when possible.

Masks are discretionary.

1 metre minimum will be required between mats during outbreaks.

The yoga teacher reserves the right to use hands on spotting if you find yourself in difficulty to prevent injury or administer first aid, and will ask permission where hands on assists are not necessary for safety, you are encouraged to say no if this makes you uncomfortable or can let the teacher know before class.

Hen do and private yoga classes where the environment isn't under TY control must adhere to current government guidelines.

The teacher reserves the right to cancel without notice and without refund should someone present COVID-19 symptoms during the class (please cancel in advance free of charge instead).

LIMITATIONS OF LIABILITY 
Tipi Yoga users are required to read and agree to the Liability Release prior to attendance of any service or activity.  If TY users do not agree to the Liability Release, they will be unable to use the TY facilities or services.

By agreeing to the Liability Release the TY user understands that the services and activities offered by Tipi Yoga includes physical movements as well as an opportunity for relaxation, stress reduction and relief of muscular tension.  As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated.  If the TY user experiences any pain or discomfort, they will listen to their body, adjust the posture and ask for support from the teacher, therapist or consultant.
The services and activities provided by Tipi Yoga are not a substitute for medical attention, examination, diagnosis or treatment. The services and activities provided are not recommended and may not be safe under certain medical conditions. The studio user affirms that they alone are responsible to decide whether to partake in the services and activities offered by Tipi Yoga and thereby agree to irrevocably release and waive any claims that they have now or hereafter may have against Tipi Yoga, the Directors, staff and teachers of Tipi Yoga.

TY accepts no liability for loss or damage to property or injury to studio users or their guests on the studio premises or outside the studio except in so far as such loss, damage, or injury is by law incapable of exclusion.

Furthermore, any online classes may only be undertaken by any and all persons that deem themselves fit and well enough to do so and the teacher is not liable to any damage that may occur to any persons or their belongings whilst following online classes. 

Tipi Yoga cannot be held responsible for any service or equipment not being available for whatever reason.  Tipi Yoga reserves the right to make alterations to the types of facilities provided, without notice and in its absolute discretion and the studio shall not be liable for any loss occasioned by such alterations except in so far as loss is by law incapable of exclusion.

STUDIO USERS 
Acceptance of a person as a Tipi Yoga user is at the discretion of Tipi Yoga.  Tipi Yoga reserves the right to withdraw, suspend or refuse attendance of any studio user whose conduct is, or may be deemed to be in the studio’s reasonable opinion, injurious to the character of the studio or amounts to a breach of the Terms and Conditions or where such expulsion is otherwise to be in the interests of the other studio users.  Any studio user so expelled shall forfeit all privileges to studio use and shall not be entitled to any refund for any period during which their membership, class pass or TY credit is suspended.

PERSONAL BELONGINGS 
Personal belongings are brought into the studio and/or external venue premises at the TY user’s own risk and TY does not accept liability for any loss or damage whatever to such items.

STUDIO OPENING TIMES 
Details of services and activity times at the studio are subject to change.  Service and activity times will be published by the studio on the website (contact page), in studio newsletters and other social media.

STUDIO FACILITIES 
A studio user is entitled to use the studio’s facilities providing always that the studio may at any time withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of the studio.

Children under the age of 16 are prohibited from using the studio facilities and partaking in services and activities without guardian supervision or in the case of Child Yoga classes, prior consent and a completed registration form detailing medical history and allergies.

The Tipi studio facilities may be impacted by adverse weather conditions, should class quality be potentially impacted the studio user must be aware that the class could be cancelled though the studio will endeavour to ​provide as much notice and be as fair as possible in such situations.

​The Tipi studio facility is essentially an outdoor​ structure, the 'square' (a section of mown grass in the field next to the Tipi open to the elements) is outdoors, the user should recognise this and dress and act accordingly. Studio users should be aware that on occasion rain or cold air may enter the Tipi despite the efforts of the Studio owner. The square is open to the elements including wind, rain and direct sun.

The studio user should note that there are currently no toilet facilities available.

In the event of a fire - though unlikely due to the lack of electrical equipment and only battery powered devices and lighting - studio users should exit calmly and safely through the only entrance/exit in the Tipi and convene in the car park next to the notice board where a head count will take place.

WRITTEN COMMUNICATIONS 
Applicable laws require that some of the information or communications the studio send to you should be in writing. When using the site, you accept that communication with the studio will be mainly electronic.  The studio will contact you by e-mail or provide you with information by posting notices on the website.  For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that the studio provide to you electronically comply with any legal requirement that such communications be in writing.  This condition does not affect your statutory rights.

NOTICES 
All notices given by you to the studio must be given to the studio owner and/or studio supervisor/staff in writing.  The studio may give notice to you at either the e-mail or postal address you provide to the studio when registration took place. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter.  In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail that such e-mail was sent to the specified e-mail address of the addressee.

EVENTS OUTSIDE THE STUDIO’S CONTROL 
The studio will not be liable or responsible for any failure to perform, or delay in performance of, any of the studio’s obligations under a contract that is caused by events outside the studio’s reasonable control (Force Majeure Event). 

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond the studio’s reasonable control and includes in particular (without limitation) the following:

(a) strikes, lock-outs or other industrial action;
(b) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
(c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
(d) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
(e) impossibility of the use of public or private telecommunications networks;
(f) the acts, decrees, legislation, regulations or restrictions of any government; and
(g) pandemic or epidemic.

The studio’s performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and the studio will have an extension of time for performance for the duration of that period.  The studio will use the studio’s reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which the studio’s obligations under the contract may be performed despite the Force Majeure Event.

PAYMENTS 
Details of prices for services and activities are available on the studio website. The studio reserves the right to change prices as and when required.

Payment for services and activities must be purchased at the time of booking. Services and activities can be booked up to 60 days in advance. When classes or services have reached booking capacity, studio users can add themselves to the waiting list.
Payments including auto-renewing payment options, class pass purchases, workshop purchases, therapy purchases, gift card purchases and any such other purchases are non-refundable but can be converted to TY credit redeemable within 6 months of the initial purchase date.

Payment for services and activities can be made over the telephone, via email or in person. Cash, online payment, cheque and debit/credit card payments are accepted.

TY CREDIT

TY credit refers to monies held by TY which can be used to purchase any services or activity provided by TY within 6 months of the purchase date (1 year for gift cards).

​

PROMOTIONS 
The studio may run promotional introductory offers from time to time, directly or through an agent i.e. Groupon/Living Social. These offers are exclusively for new studio users who are not already registered with the studio and are not for repeat use (unless otherwise stated).

​

THE WEBSITE 
When using the website, the studio user/website viewer agrees to:
Seek the studio’s written permission if they would like to link to the website or copy the content in any way, shape or form.  By supplying the studio with material via digital or hardcopy, they allow the studio unlimited, royalty free use of its content. 
Anyone infringing on the aforementioned terms could be excluded from the use of the studio website.

SAFETY & HYGIENE 
Smoking is not allowed anywhere on the premises, including the car park.
No crockery, glass or food is permitted in the studios.

Fire exits, which are clearly marked, are there in the interests of safety.  In the event of a fire, studio users are asked to make their way to the nearest available exit.

Studio users must bring their own equipment to class inclusive of yoga mats and aids such as blocks, bolsters, eye bags, etc and let the TY teacher know in advance if they need to borrow such equipment.

Studio users are required to address any foot hygiene and/or any contagious issues they may have to avoid spreading infection to others, they may be refused the service or activity should issues present themselves with no refund.

GENERAL GUIDELINES 
Studio users must at all times observe the studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the studio may issue to ensure the smooth operation of the studio for the convenience of all studio users and members.

Studio users are required to give notice to the studio of any change of contact details. Failing such notice, all communications shall be assumed to have been received by the studio user within five days of mailing/emailing the last known address. 

The studio reserves the right to refuse admission to the studio or the use of studio facilities.

A person who is not a party to the liability release and terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any terms listed here or use any of the facilities provided by the Tipi Yoga studios and services.
The studio may, if a studio user so wishes, communicate with the studio user by email.  By providing an email address to the studio, the studio user consents to receiving email communications from the studio, including notices pursuant to the Terms and Conditions. The studio user also accepts any risk that email may not be a fully secure and confidential means of communication. The studio will not be liable for any loss or damage suffered as a result of communicating with a studio user in this manner.

BOOKING AND CANCELLATION POLICY

Booking 
All classes, treatments and workshops must be paid for at the time of booking, either via email, over the phone, via cheque or in person with cash.

​

They can be booked up to 60 days in advance and up to 30 minutes prior to the class start time.

  • Courses inclusive of Child Yoga must be paid for upon booking, partial payments are not accepted. If payment has not been received the space is not guaranteed and the participant cannot take part in the first class of the course or any thereafter until payment is received - children will not be collected from school or allowed to take part in the class.

  • There is a 50% deposit required at the time of booking for corporate or Hen Do classes and treatments. Full payment to be received no less than 15 days prior to the (first) booking.

  • Full payment must be made when booking treatments, therapies, workshops, private yoga and group yoga.

  • Tipi Yoga group classes are book on:​

    • The weekly group classes take place in Etchingham Parker Hall, Eridge Village Hall, and, when warm enough, next to or in the Tipi (subject to venue availability) and requires pre booking each month. To book the dates that you wish to attend email ebony@tipiyoga.co.uk. Insufficient interest/bookings will result in individual classes being cancelled with notice. To book on you must pre-pay for your chosen classes either via your class pass or pre-payments of the number of classes you wish to attend at the one class pass rate. Class pass information is found on the Yoga page of this website. Provided that the classes go ahead as planned these bookings are non-refundable.

Cancellations, Late Pick Ups, No Shows & Late Arrivals

  • Cancellations should be made by phone or email and require a reply or 48 hours minimum to be valid.

  • A strict 48-hour cancellation policy is in operation for all Tipi Yoga classes (private and group) and treatments. A 14 day policy is in place for workshops, hen dos and corporate bookings; all cancellations made with less than 48 hours’ or 14 days notice will be charged the full price. Cancellations made outside of the window stated can be converted to TY credit (detailed above) or refunded. If you have not yet paid but have cancelled outside of the stated windows please make your payment within 5 working days.

  • Accounts will be debited for no shows and late arrivals, if payment has not been made in advance then the full payment is to be sent via BACs as soon as possible within 5 working days.

  • Late arrivals for reasons not due to the teacher will not be allowed entry in to group classes. Other classes, activities and services will end at the previously agreed time.

  • Late Pick Ups refer to Child Yoga classes. If collection is later than 15 minutes past the end of the class then a late fee of £10 per 15 minutes will need to be paid in BACs or cash at the time of collection.

Early Cancellation 
Tipi Yoga classes and treatments can be cancelled up to 48 hours before the class start time without incurring a charge. The same applies to workshops, hen dos and corporate bookings but with 14 days. These purchases can be transferred to TY credit or refunded.

​

Late Cancel 
If a class or treatment cancellation is made 48 hours or less prior to the class start time or 14 days or less prior to the hen do, corporate yoga or workshop booking, the credit will be deducted from the user’s TY credit amount/activity or service purchase, or the user will need to make a payment in full via BACs as soon as possible. No refund will be given for the booking.

No Show 
If a client fails to turn up for a service or activity without prior notice (“no-show”), the class credit will be deducted from the client’s account or they will be required to make a full payment via BACs as soon as possible. No refund will be given for the service or activity missed.

NB: Payments are non-refundable or transferable for any reason, including, but not limited to vacation, illness, injury, travel delays and arriving after the class has begun. The cancellation policy applies to all clients. If notice is given before class begins then the client will not be noted a 'no show' (leniency will be factored with emergencies), if a client is noted as a no show 2 times or more within 6 week then their attendance in classes will be paused for 4 weeks to prioritise the committed clients spaces in class/ the teacher's timetable. They are very welcome back after the 4 week pause.

Waiting Lists 
If a space becomes available in class prior to the class start time, the first studio user on the waiting list will be added to the class and will be emailed and texted a notification if both communications have been provided. Studio users must opt-in to receive these notifications through ebony@tipiyoga.co.uk. The studio user will need to confirm they wish to attend by replying to the notification email or text within 1 hour in order to guarantee their space. If a confirmation is not received within 1 hour the next person on the waiting list will be contacted and the studio cannot guarantee the availability of the space. Once the space has been confirmed normal booking terms apply.

Class Pass Expiration 
Class passes cannot be extended beyond their expiration date. If there is credit remaining on a class pass and the pass expires, the credit will no longer be valid.

​

Studio Closures & Cancellations 
If the studio or teacher cancels classes or services where studio users have been scheduled into the class or service no credit will be deducted from users’ accounts and the option to re-book another class or service will be given. In the case of workshops, treatments and all services other than yoga class passes and group yoga classes a refund can be issued if preferable to TY credit.

The studio retains the right to close the studio as and when required for the purpose of emergencies, national holidays, maintenance and repairs.

Retail 
Returned merchandise, excluding used or opened products/packaging, will be fully refunded if returned within 28 days of purchase with a receipt.

​

Refunds
Tipi Yoga does not offer refunds on products, classes, deposits, class passes, gift cards or treatments except in the circumstances outlined above.

​

Sub-contraction Terms

Tipi Yoga teachers offer services in gyms, spas and other wellness and fitness based venues around Sussex. 

Cancellation: external venues may cancel these services for free with a minimum of 7 days notice. If cancellation takes places within 7 days of the service start time the full agreed amount will be charged on the next invoice.

Payment: TY will invoice the external venue after the last service of the month takes place. There is a 14 days payment window following issue of the invoice.

Liability and health: TY will not issue health and liability forms to external venue clients but requires that due diligence has taken place prior to the booking and requires that health issues be disclosed no less than 24 hours prior to service start time to give the TY issuer time to prepare a suitable service. The TY issuer reserves the right to refuse clients should their welfare be at risk. Correct insurance must be in place for services to take place.

Tipi Yoga respects the privacy of all who visit this website and use the Tipi Yoga studio facilities. This privacy policy outlines the information which may be collected by Tipi Yoga and how this information may be used.

To assist Tipi Yoga with improving the services offered to you, you may be asked to provide personal details such as your name, email and postal address. This information may be used for the purpose of providing, monitoring, assessing and marketing Tipi Yoga. Tipi Yoga may also use your personal information to inform you of news updates, offers, services and products that are relevant to Tipi Yoga. Tipi Yoga will not sell, share, rent or otherwise distribute any personal information to third parties.

Any information provided relating to your health will be used solely for the purpose of assessing the safety and possible risk of exercising based on the answers to the questions given by you to Tipi Yoga.

Any information supplied by you to Tipi Yoga via this website or paper registration form will only be used in accordance with the Data Protection Act 1998.
